1. Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and The Acade (“Company,” “we,” or “us”). By downloading, accessing, or using the The Acade App or web dashboard, you agree to comply with and be bound by these Terms.

If you are agreeing to these Terms on behalf of an educational institution, school, or organization, you represent that you have the authority to bind that institution to these Terms.

2. Unified Single App & Role Access

The Acade App operates as a single application with role-based access:

• Parent Login: Access granted to parents or legal guardians to view academic marks, attendance records, school announcements, and safety alerts for their enrolled children.
• Teacher & Admin Login: Access granted to verified school staff and administrators to manage class profiles, upload marks, track attendance, and oversee institutional financial reports.
• Account Security: You are responsible for safeguarding your account credentials. You must immediately notify school administrators or The Acade support if you suspect unauthorized account access.

3. School Onboarding & Responsibilities

Schools onboarded onto The Acade agree to:

• Provide accurate student enrolment data, class rosters, and authorized teacher profile credentials.
• Ensure that all marks, attendance entries, and financial entries uploaded to the platform are accurate and truthful.
• Obtain any required parental consent for digital academic record management in compliance with applicable education laws.

4. Acceptable Use Policy

You agree not to misuse the platform. Specifically, you must not:

• Attempt to gain unauthorized access to accounts, student records, or school administrative data outside your permitted role.
• Upload false, misleading, defamatory, or harmful content.
• Interfere with the security, performance, or availability of the application server or network infrastructure.

5. Intellectual Property Rights

All visual interfaces, source code, graphics, brand logos, trademarks, and design components of The Acade are the exclusive property of The Acade. You are granted a non-exclusive, non-transferable, revocable license to access the application for institutional or parental use.

6. Service Availability & Maintenance

While we strive to ensure 99.9% application uptime, The Acade services may occasionally undergo scheduled maintenance, updates, or emergency bug fixes. We are not liable for transient service disruptions resulting from internet service provider outages or external cloud events beyond our reasonable control.

7. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Coimbatore, Tamil Nadu, India.
